We are pleased to welcome you to our website www.draegerparis.com (hereinafter referred to as the "Site").

These general terms and conditions of sale exclusively govern the sales of products offered on the Site. They are systematically accessible on this Site by the Customer at the time of registration of the order.

Consequently, placing an order implies the Customer's full and unreserved acceptance of these general terms and conditions of sale.

Any contrary condition set by the Customer will therefore, in the absence of express acceptance, be unenforceable against DRAEGER regardless of when it may have been brought to its attention. The fact that DRAEGER does not assert any of these general terms and conditions of sale at a given time cannot be interpreted as a waiver of the right to assert any of the said conditions at a later date.

DRAEGER strives to ensure to the best of its ability the accuracy and updating of the information published on the Site, and reserves the right to correct the content at any time and without notice.

If a condition were to be lacking, it would be considered to be governed by French customs and laws in force in matters of distance selling.

I. PURPOSE

These conditions of sale aim to define the contractual relations between Draeger and the buyer and the conditions applicable to any purchase made through the Draeger merchant site www.draegerparis.com whether the buyer is a professional or a consumer.
The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale shall prevail over any other general or specific conditions not expressly agreed to by Draeger.
Draeger reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

II. CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED

The products and services offered are those which appear in the catalogue published on the Draeger website www.draegerparis.com
These products and services are offered while stocks last.
Each product is accompanied by a description established by Draeger.
The photographs in the catalog on the screen are as faithful as possible but cannot ensure perfect similarity with the product offered, in particular with regard to colors, in particular because the vision of colors depends on the calibration of the Internet user's screen.

III. PRICES

The prices listed in the catalog are inclusive of tax in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

Draeger reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
Prices shown include order processing fees. Shipping and delivery costs are the responsibility of the buyer.

V. ORDERS

The buyer, who wishes to purchase a product or service, must:
– complete the registration form on which he will indicate all the requested contact details or identify himself if he has created a customer account;
– fill your online basket by selecting the product(s) of your choice by clicking on “Add to basket”.
– validate your order after having checked it;
– make the payment under the conditions provided;
– confirm your order and payment.
Confirmation of the order entails acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on one's own conditions of purchase or other conditions.
All data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out.
Draeger will communicate by e-mail the confirmation of the registered order.

VI. RIGHT OF WITHDRAWAL

In accordance with the law, the Customer has a right of withdrawal for a period of 14 (fourteen) days from receipt of his order, which he can exercise without having to justify his decision or bear any costs other than those necessary for returning his order, provided that the products are returned in their original packaging and in perfect condition within 14 days of delivery.

Damaged, soiled or incomplete items will not be accepted.
Return costs will be the sole responsibility of the Buyer.
The return of products must be accompanied by a return slip and the invoice.

The exchange (subject to availability) or refund will be made within 15 days of receipt by Draeger of the items returned by the Buyer.

VII. PAYMENT TERMS

The price is payable upon ordering.

Draeger works with Payplug, a secure payment solution. So when paying by credit card, you will be automatically redirected to the online payment platform.

You can then securely transmit your bank details since the data is encrypted by the "Security Socket Layer" security system (SSL technology). Draeger does not have access to your bank details at any time.

You can also pay using Paypal. Payments will be made through PayPal's secure system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can read it during transport over the network.

With PayPal you are protected from payment to delivery. PayPal secures your financial information and your purchases are delivered or refunded.

With PayPal you can pay with a credit card (without opening a PayPal account) and benefit from secure PayPal payment.

A delivery note will be attached to all shipments.

VIII. DELIVERIES

Packages are delivered to your home by Colissimo in France and all other countries mentioned in the “geographic area” paragraph.

Draeger processes orders Monday through Friday.

In general, all orders are processed within 1 to 2 business days. Additional delays are those practiced by our transport partners. The total shipping and delivery time is estimated between 3 and 5 days.

Please note that during certain periods (Sales, Private Sales, etc.) processing times may be longer due to the large number of packages to be processed.

Delivery costs depend on the geographic area.

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.

Draeger makes every effort to meet these delivery times.

However, Draeger cannot be held responsible for the consequences due to a delay in delivery or loss for any reason whatsoever.

Delivery times related to the post office or any other carrier are not the responsibility of Draeger.
The risks are borne by the buyer from the moment the products leave Draeger's premises. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.

Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

IX. WARRANTY

The products supplied benefit, in accordance with legal provisions,
- the legal guarantee of conformity,
- the legal guarantee against hidden defects arising from a material, design or manufacturing defect affecting the products delivered and making them unfit for use.

Any warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the buyer, as in the event of normal wear and tear of the goods, accident or force majeure and Draeger's warranty is limited to the replacement or reimbursement of non-compliant or defective products.

In order to assert its rights, the Buyer must, under penalty of forfeiture of any action relating thereto, inform Draeger, in writing, of the existence of the defects within a maximum period of 7 days from their discovery.

Draeger will replace products under warranty that are deemed defective. The products sold on the website comply with the regulations in force in France. Draeger cannot be held liable for non-compliance with the legislation of the country in which the products are delivered, which it is the Buyer's responsibility to verify.

The photographs and illustrations accompanying the products on the website have no contractual value and therefore cannot engage the responsibility of Draeger.

The Buyer is solely responsible for the choice of products, their storage and their use.
Draeger will not be held liable or at fault for any delay or non-performance resulting from the occurrence of a case of force majeure usually recognized by French case law.

All complaints, requests for exchange or refund must be made by e-mail to the following address: e.commerce@draegerparis.com, within a maximum period of thirty days after the date of delivery.

X. RESPONSIBILITY

Draeger, in the online sales process, is only bound by an obligation of means, its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.

XI. INTELLECTUAL PROPERTY

All elements of the www.draegerparis.com site are and remain the intellectual and exclusive property of Draeger.

No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio.

XII. PERSONAL DATA

In accordance with the law relating to information technology, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing.

Draeger reserves the right to collect information about buyers including by using cookies.

However, Draeger is prohibited from distributing this information to anyone and will only use it within the framework of its commercial relationship with the buyer.
Buyers have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978. It is also entirely possible to consult or modify personal data in their account.

Draeger will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
Draeger's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

XIII. APPLICABLE LAW AND MEDIATION - COMPETENT COURT

This contract is subject to French law.

XIII.1 Complaints

In the event of a dispute, the consumer must contact the Seller's customer service at the number indicated in the header of these General Terms and Conditions, not surcharged from a landline in mainland France, from Monday to Friday except on public holidays or bank holidays, or by email or post, at the contact details indicated in the header of these General Terms and Conditions.

XIII.2 Mediation

In the event of failure of the complaint request to customer service or in the absence of a response from this service within two months, and in accordance with Article L. 612-1 of the Consumer Code, the Customer, subject to Article L.612.2 of the Consumer Code, has the option of submitting a request for amicable resolution by means of mediation, within a period of less than one year from his written complaint to the Seller.

The request for mediation must be sent to SAS Médiation Solution in accordance with the following procedures:

Whatever the means of referral used, the request must imperatively
contain :

  • The postal, telephone and electronic contact details of the
    applicant,
  • The name, address and registration number of the Seller at Sas Médiation Solution (no. 31097/VA/2112)
